It contains the Terms of Access to and Use of the Mobile Application of www.nploy.net (the “Terms”). If you do not accept the Terms stated here, it is not possible to use the Site! Use of the Services available without registration will be deemed to be an expression of consent to these Terms. In connection with the Services provided, NPLOY.NET processes personal data in accordance with the Privacy Policy ("Policy"), which you can read here. The policy is an integral part of these Terms. Registration
1.1. "NEW HIGHERS" JSC. with trademark NPLOY (No. 017904120 / EUIPO) ("NPLOY.NET" / "We" / "Us") with registered office: Blvd. Evlogi and Hristo Georgiev №44, Sofia 1124, UIC: 206725192 provided by website and mobile application www.nploy.net ("Site" and "Mobile Application") of individuals - end users ("Candidates" / "You") free information society services ("Services"). The services include opportunities to search for vacancies, create and store CVs and files, send applications, etc.1.2. In order to use the Services, you guarantee that you have reached the age of 18 and are capable of concluding a contract. NPLOY.NET is not responsible in case of use of the Services by a person who does not meet the specified age and legal capacity restrictions.1.3. The use of part of the Services is possible only with registration. The registration is done in person, and registration on behalf of other persons is not allowed. Upon registration you are required to fill in the required fields in the registration form (name, email address, etc.). You declare that you meet the requirements of item 1.2.1.4. You agree to provide accurate, complete and up-to-date registration information and to maintain it. In case of inaccuracy in the data, you are not entitled to use the Services until its removal. 1.5. You are responsible for all actions performed through your account using your username and password. You agree to notify NPLOY.NET immediately in the event of unauthorised or probable access.

Registration
1.1. The services include opportunities to search for vacancies, create and save CVs and files, send applications and more.

1.2. In order to use the Services, you guarantee that you have reached the age of 18 and are capable of concluding a contract. NPLOY.NET is not responsible in case of use of the Services by a person who does not meet the specified age and legal capacity restrictions.

1.3. The use of part of the Services is possible only with registration. The registration is done in person, and registration on behalf of other persons is not allowed. Upon registration you are required to fill in the required fields in the registration form (name, email address, etc.). You declare that you meet the requirements of item 1.2.

1.4. You agree to provide accurate, complete and up-to-date registration information and to maintain it. In case of inaccuracy in the data, you are not entitled to use the Services until its removal.

1.5. You are responsible for all actions performed through your account using your username and password. You agree to notify NPLOY.NET immediately in the event of unauthorised or probable access.

Conclusion of a contract
2.1. By clicking on the "Registration" button and confirming the registration email you have received, you make an electronic statement by which you enter into a contract with Us under these Terms and undertake to comply with them. Before clicking the "Register" button, you have the opportunity to view and edit the information you provided. You accept that the electronic statements to NPLOY.NET and the electronic statements from NPLOY.NET to you will be considered signed with a simple electronic signature in accordance with Art. 3 (10) of Regulation (EU) № 910/2014, by hand signature. The authorship of these statements will be established by the order of art. 13, para. 1 in connection with art. 13, para. 4, assoc. 2nd of the Law on Electronic Document and Electronic Certification Services (“ZEDEUU”).

2.2. Some of the Services are provided without the need for registration. In such cases, the consent to these Terms is expressed with the very beginning of the use of the Services.

2.3. In connection with the provided Services, communication between you and NPLOY.NET via e-mail is required. According to Art. 5 of ZEDEUU You agree to be the addressee of electronic statements from NPLOY.NET in electronic form.

Use of the Services and content on the Site and the mobile application

3.1 The site allows for the publication of vacancy announcements by Employers. The advertisements and their content are entirely the responsibility of the Employer from whom they were published. The mobile application allows you to apply for ads published on the site.

When you apply for a position in the platform, you agree that your personal information can be and will be processed by the Employer, which has posted the particular job posting. After each of your application in the platform, your personal information is automatically sent to the Employer's account at NPLOY.NET, as well as to any external recruitment system that the Employer might have linked to their account.

Your applications and personal information will be stored in the Employer account for data processing purposes for a period of up to 6 months.You decide which ads and which Employers to send your applications to. For this purpose, before applying, we recommend that you look for more information about the Employer in the mobile application itself, as well as from other sources.

3.2. NPLOY.NET is not an intermediary and does not participate in any way in the selection of candidates or subsequent communication and negotiation of terms between the parties. Decisions about what information to send, what contractual relationships you wish to enter into and under what conditions are entirely your responsibility. NPLOY.NET is not a party to this relationship and therefore, in case you believe that the Employer does not comply with the agreed conditions and / or his actions are not in accordance with the law, it is necessary to notify the competent state authorities in whose competences and powers is to carry out the relevant inspections and take action against the Employer. Use of the Services is at your own risk and responsibility.

3.3. You may not use, in any way, copy, modify or distribute content that does not belong to you for purposes other than or incompatible with the use of the Services and the purpose of the mobile application without the express prior written consent of NPLOY .NET and / or relevant third parties.

3.4. The published contacts of Employers and / or their Representatives may be used only for their intended purpose, namely in connection with applying for advertised positions. You agree not to use these contacts for any other reason.

3.5. You agree not to interfere with the normal operation of the technical or software applications and computer systems of NPLOY.NET or the users of the Site and the Mobile Application through bad faith actions.

Creating and storing resumes, files, etc. information
4.1. The Mobile Application allows you to create and / or save professional CVs, files, etc. information that you can send, at your discretion, to Employers on advertisements published by them.

4.2. The documents stored in the Mobile Application are available only to you. When applying and being liked by an employer, your information is available only from Employers with whom you have had a “like”. When you send / apply for / on your application, it automatically reaches the Employer's account.

4.3. You warrant that you have the right to use the content you store in your account or send to others through the Mobile Application, and that it does not violate these Terms or the law. If this is not the case, you are liable for any damages resulting from it to third parties and / or NPLOY.NET.

4.4. The information that you store in your account and / or send to others through the Mobile Application may not contain: (a) non-application advertising content, (b) materials that violate or disregard the rights or legitimate interests of third parties , including fundamental human rights, intellectual property rights, etc .; damage the good name, insult a third party or reveal a secret protected by law.

Account termination
5.1.
Your account may be closed in the following cases:
(a) at any time, at your request (through the functionality in the Mobile Application),
(b) in case of a long period of non-use of the account (more than 5 years);
(c)in case of suspicion of violation by you of these Terms, of other conditions provided in the Site, the Mobile Application or in the law,
(d) in other cases, at the discretion of NPLOY.NET, with prior notice.

5.2. Your account may be blocked in the following cases:
(a) in case of suspicion of violation of these Terms, other conditions provided for in the Site or the law,
(b) upon request by a competent public authority;
(c) request on your part, if there is a good reason for it.

5.3. Upon closing an account and terminating the contract, the data stored in the Mobile Application are deleted. This includes both the data in your account and applications submitted by you in the accounts of Employers on the Site (at the time of closing).

After closing the account, all data, part of it, is deleted. In connection with our obligations, responsibilities and requirements of the law for a period of up to 1 / one / year are stored:

- In order to resolve possible disputes that have arisen or become known after the termination of the agreement for the use of the Services, for a period of 1 / one / year after the termination of the account information about its conclusion is stored. See section "Shelf life".

-Due to the fact that sending an application is sending an electronic statement by you to the employer, according to ZEDEUU we have the obligation to maintain a log of the fact of sending the statement (without its content) for a period of 1 / one / year. The log contains the date of the statement, name and email address of the sender and identification of the recipient.

The data shall be deleted completely after the expiry of the specified period. In the meantime, they may be provided only in due course to the competent state authorities in the exercise of their supervisory powers or to a competent court in the event of legal proceedings in which they are relevant. In the event of a legal dispute or proceedings requiring the retention of data and / or a request from a competent state authority, it is possible to retain data for longer than the specified periods until the final conclusion of the dispute or proceedings before all instances.

5.4. Before closing your account, if you wish, you have the opportunity to download and save data contained in it, through the provided functionality.

5.5. Upon termination of the contract according to the cases provided for in item 5.1, NPLOY.NET does not take responsibility for lost profits and / or damages from the inability to use the Services after closing the account.

Changes

6.1. NPLOY.NET reserves the right to add new Services, modify or remove existing Services without prior notice.

6.2. These Terms may be changed in connection with the development, addition of new, change or termination of Services or legislative changes. When making changes, they will be brought to your knowledge and published here.

6.3. Due to the fact that the Services can be used only in accordance with the current Terms, in case you do not agree with them, we do not have the technical ability to provide you with the Services in the Mobile Application. If you do not agree to the Terms, you must not use the Mobile Application. If you wish, you have the opportunity to close your account and terminate the contract at any time.

Others
7.1. Except in case of intent or gross negligence, NPLOY.NET shall not be liable for damages and lost profits resulting from:
(a) use or inability to use the Mobile Application and / or the Services;
(b) deletion or blocking of your account; and / or your content in accordance with these Terms.

7.2. The contract is concluded in Bulgarian. Disputes under these Terms will be resolved by the competent Bulgarian court in Sofia.

7.3. In the event that any of the clauses of these Terms proves to be invalid, this will not invalidate other clauses.

7.4. The legislation of the Republic of Bulgaria shall apply to unsettled issues.

Registration
1.1. New Highers JSC. under the trademark NPLOY (No.017904120 / EUIPO) ("NPLOY.NET" / "We" / "Us")with registered office: 44 Evlogi and Hristo Georgiev Blvd., Sofia 1124, UIC:206725192 provides through the website www.nploy.net (the “Site”) of legal entities and individuals with valid registration in the Commercial / BULSTAT Register - Employers (“Employer (s)”, free and paid information society services (the “Services”). The services include, without exhaustion until, the publication of vacancy announcements by Employers and the possibility to store on the Site applications received from the Employer on advertisements published by him.

1.2. 
The use of the Services is possible only after registration of a company account and its activation.

1.3. 
The registration of a company account is performed by an able-bodied person who declares that he is authorised to represent the Employer, including to accept these Terms and to perform actions related to the use and management of the company account on behalf of theEmployer. In case you create a registration, you declare that you meet the specified conditions and the information you have filled in, identifying you and the Employer, is complete and accurate.

1.4. 
The employer may choose to add an administrative contact person other than the person making the registration. In this case, this contact is filled in during registration by the person authorised to perform the registration. This is the contact with which our employees can contact on important issues related to the use of the Services. The employer undertakes to keep this contact up to date.

1.5. 
The Employer has the opportunity to add additional persons - company users ("Representatives" /"Employer Representatives") with access or additional sub-account to his company account. Each of these persons is required to agree to these Terms before using the Services. The addition of additional persons - company users and the determination of their rights on the Site is performed by the person who created the registration and / or other previously added company users with the necessary rights. By adding an additional person - a company user, you declare that you are authorised by the Employer.

1.6. 
In connection with its obligations under theGeneral Regulation on Personal Data Protection ("Regulation (EU)2016/679"), the employer undertakes to fill in a contact point for applicants on issues related to the protection of their personal data. Due to the fact that such questions may arise after the expiration of the advertisements, the Employer undertakes to keep the contact up-to-date at anytime, regardless of whether there are active advertisements on the Site. This contact, together with the data identifying the Employer, is published publicly on the Site.

1.7. 
The Employer and each of its Representatives undertake to provide accurate, complete and up-to-date data during the registration and each use of the Services and to maintain them as such. In case of inaccuracy in the data, you are obliged to remove it immediately and you are not allowed to use the Services until its removal.

1.8. 
In addition to the data filled in at registration, NPLOY.NET reserves the right to require the submission of additional documents, including signed (manually or electronically), for additional identification of the Employer and / or Representatives when activating the account or at any time thereafter. raising doubts about the accuracy and completeness of the data provided.

1.9. 
You are responsible for all actions performed through your account using your username and password to access it. You undertake to notify NPLOY.NET immediately in case of unauthorised access or probability of such access. Conclusion of a contract

2.1. 
By clicking on the "Registration"button and confirming the registration email received from you, the person representing the Employer makes an electronic statement by which the Employer and the Representative enter into an agreement with NPLOY.NET under these Terms("Agreement") and undertake to comply with them. . The information entered in the registration form can be changed by pressing the"Register" button.

2.2. 
The contract is considered concluded from the moment of activation of the account by NPLOY.NET

2.3. 
For the use of each paid Service a specific request is made on the basis of the contract concluded under these Terms.

2.4. 
By accepting these Terms, you agree to be the addressee and receive electronic statements from NPLOY.NET in connection with this Agreement and the Services on the Site.

3.1. 
You undertake to use the Site in accordance with these Terms, the additional conditions and guidelines applicable to the individual Services published on the relevant pages of the Site, and the applicable Bulgarian legislation.

3.2. 
You undertake to publish only advertisements for real and current positions, as:
(a) the chosen settlement must correspond to the workplace (place of work) and it is not allowed to publish advertisements with more than one settlement; publication of more than one post in the same advertisement.

3.3. 
It is not allowed to use ads to promote business opportunities, partnerships, products, services or sites, requirements for joining social media pages, registrations, participation in games, pyramid schemes, etc. You agree that Applicants are not required in any form to purchase training or other services.

3.4. Your advertisement may not contain:
(a) requirements of a discriminatory nature,
(b) materials that violate or disregard the rights
(c) or legitimate interests of third parties, incl. fundamental human rights, intellectual property rights, etc .; to offend a third party.

3.5. 
NPLOY.NET reserves the right to remove or request editing of advertisements / advertisement elements or other content published by you that does not comply with these Terms or the additional terms and conditions published on the Site.

3.6. 
You warrant that you have the right to use any content you post on the Site. If this is not the case, you are liable for any damages resulting from this to NPLOY.NET or third parties.

3.7. 
You give NPLOY.NET the right to make available(both for the country your company is based in, and outside of the country your company is based in) the ads published by you and other public content, this is for the purpose of providing the Services and NPLOY.NET does not owe any remuneration.

3.8. 
By publishing content on the Site, you grant it's users the right to access and use it in accordance with the Terms of Use by individuals and in accordance with the law.

3.9. 
NPLOY.NET reserves the right to refuse, suspend or terminate the provision of the Service:
(a) in the event of unfair conduct on the part of the Employer (e.g. posting false or misleading advertisements; referring to competing sites, etc.);
(b) in case of establishment of activitiessimilar to those performed through this Site,
(c) in case of suspicion of violation of theseTerms or the law,
(d) in amounts due, not paid on time and / or in full.

3.10. 
In order to ensure the reliability and security of the Service, NPLOY.NET reserves the right to seek assistance from the competent authorities in case of gross violations of these Terms.

3.11. 
Posting an ad on the platform

3.11.1. 
Posting an ad with a custom title. If you want to publish an ad with a dream title that does not appear in the system (custom title), you need to comply with item 3.4 and agree that the custom title of your ad is subject to quality control by Administrator. In case your custom title meets our quality requirements, it will be approved by the Administrator within 24 hours, and from that moment your ad will be visible to candidates in the system. In case your custom title does not meet the our quality requirements, it will not be approved by the Administrator and your ad will not be visible to candidates in the system.

Use of the content
4.1. 
The site and its content are the property of "New Highers" JSC. and / or its partners, suppliers and customers. You may no to use in any way, copy, modify or distribute content that does not belong to you for purposes other than or incompatible with the use of the Services and the purpose of the Site, without the express prior written consent of NPLOY.NET or relevant third parties.

4.2. 
The published contacts of Employers and theirRepresentatives may be used only for their intended purpose, namely in connection with applying for published advertisements. You agree not to use these contacts on any other occasion, including, but not limited to, for marketing and promotional purposes.

4.3. 
You agree not to interfere with the normal operation of the technical or software applications and computer systems of NPLOY.NET or the users of the Site by unscrupulous actions.

4.4. 
Unlocking of interested candidates
Candidates have two statuses in the system -Unlocked and Locked.
Locked candidate: This is any candidate who has expressed interest in an ad, but has not been approved by you. Locked candidates have a limited profile in which you cannot see contact and personal information. (Name, e-mail, telephone and attached documents.)
Unlocked candidate: Once you approve an interested candidate for an ad, he becomes unlocked. This allows you to communicate directly in the system through a chat function and his personal information becomes available (Name, e-mail, phone and attached documents). In order to unlock a candidate, your ad must be active (p.6.8.1.2)

4.5. Talent Database
This feature allows you to view all candidates registered in the system and show interest in them for a particular ad of yours. After showing interest in a candidate, the specific ad will be displayed with the highest priority and distinctive design the next time the candidate enters the mobile application. If the given candidate shows interest in the given advertisement, his account becomes unlocked (item 4.4) in the given advertisement.communication with the given candidate. The function guarantees only that your ad will be visualised with the highest priority and distinctive design. Access to this function is possible only with a purchased "subscription unlimited".

Processing of personal data
The issues related to the processing of personal data in connection with the provision of the Services are regulated in the Privacy Policy, an integral part of this Agreement.

Financial conditions
6.1. 
The prices of the paid Services are calculated automatically depending on the selected parameters and according to the prices and terms for payment published on the Site at the moment of ordering the specific Service.

6.2. 
Financial terms and prices may be changed unilaterally by NPLOY.NET. Such changes do not affect the conditions for providing already requested and confirmed by NPLOY.NET Services.

6.3. 
Payment for the Services is made in one of the ways specified on the Site in accordance with the deadlines set for this. All pro forma invoices are available in the Employer's account on the Site. The employer is obliged to monitor and observe the observance of the terms for payment of the issued documents. After successful payment, New Highers JSC. will issue and send an invoice for the product to the e-mail address specified by you in the system.

6.4. 
After confirmation of an order for a Service byNPLOY.NET, it cannot be terminated by the Employer. In these cases, payment of the price for the requested Service is due in full and amounts paid are not refundable.

6.5. 
NPLOY.NET reserves the right to refuse the publication of an advertisement or the provision of another Service, in case of non-compliance with the Terms and / or at its discretion.

6.6.
 In case of delay in payment, access to the Services on the Site is restricted.

6.7.
 Packages

6.7.1 Single job ad This package has two statuses -active and inactive.

6.7.1.1 
An inactive ad is an ad that is published in the system for a period of 28 days but is not paid. This ad is visible to candidates in the mobile application and they may be interested in the position. Employers can monitor the activity on the ad and view profiles of candidates who have expressed interest, but do not have the opportunity to unlock these candidates (item 4.4).

6.7.1.2 
An active ad is an ad that is published in the system and is paid. The term of the active announcements is 28 days after the day of payment. After activating an ad, employers have the opportunity to unlock (item 4.4) interested candidates and communicate with them in the system.

6.7.2 
Subscription Essential - After purchasing this type of subscription, you have the opportunity to publish an unlimited number of active ads in the system within 1 calendar month. The company and all ads published by it appear in the section "top employers" in the mobile application.

6.7.3 Subscription Plus
- After purchasing this type of subscription, you have the opportunity to publish an unlimited number of active ads in the system within 1 calendar month. The company and all ads published by it appear in the section "top employers" in the mobile application. You can add up to five (5) people to the team. You have access to the candidate database in the system (item 4.5). You can hide the salary range from your job postings.

6.8.4 Subscription Partner -
After purchasing this type of subscription, you have the opportunity to publish an unlimited number of active ads in the system within 1 calendar month. The company and all ads published by it appear in the section "top employers" in the mobile application. You can add up to forty (40) people to the team. You have access to the candidate database in the system (item 4.5). You can hide the salary range from your job postings.You have included recruitment marketing and / or employer branding services, which are specified in your official offer.

6.8.5 Subscription Database Diver -
After purchasing this type of subscription, you have access to the candidate database in the system (item 4.5).

6.9. 
Financial Conditions for publishing an ad with a personalised title. If a service (announcement) is published with a personalised title and paid for before the approval of the title (item 3.11) by an Administrator, you are obliged to contact New Highers JSC. in order to adjust the quality of the published content. In the absence of contact on your part - New Highers JSC. does not owe a refund of the amount paid. Marketing Services These terms and conditions ("Terms") govern the promotional campaigns conducted onNPLOY.NET's recruitment platform ("Platform") as part of the'Partner' subscription. By subscribing to the 'Partner' plan and engaging in promotional activities, you ("Client") agree to abide by these Terms.

7.1
Marketing Services and MaterialsAll marketing services, budgets, and materials related to promotional campaigns shall be clearly defined in the official offer and/or contract provided for corporate subscriptions. The Client acknowledges and agrees to the specified terms and conditions as set forth in the offer or contract.

7.2
Ownership ofMarketing MaterialsAll marketing materials and content produced during the Client's subscription arrangements with NPLOY.NET shall remain the sole property of New Highers JSC, the sole administrator and intellectual owner of NPLOY.NET. The Client may not use, copy, modify, or distribute the content without the express prior written consent ofNPLOY.NET or relevant third parties.

7.3
Co-Branding of Marketing Materials Marketing materials used for digital, outdoor, and any other form of advertising shall be co-branded with the Client's corporate logo and the corporate logo of NPLOY.NET, as agreed upon in the subscription arrangement.

7.4 Advertising Budget
The advertising budget used for the promotional campaigns shall be clearly defined in theClient's subscription offer. If the Client wishes to allocate additional advertising budget, New Highers JSC, which is the sole administrator and intellectual owner of NPLOY.NET, shall issue an invoice for the additional amount.

7.5 Utilisation of Unspent Marketing Budget
In the event of unspent marketing budget, either allocated from the subscription amount or additionally allocated through an invoice, the Client is required to facilitate its usage for promotional activities through clear intent and available job advertisements on NPLOY.NET no later than 25 days prior to the subscription expiry date.

7.6
NPLOY.NET Discretion in Unspent Budget UsageIf there is still unspent marketing budget after the defined period in item 7.5, and the Client has not demonstrated intent for its usage, NPLOY.NET is not obligated to spend the budget for promotional services, and the Client shall not be entitled to a refund for the unspent amount.

7.7
Corrections of Materials During the promotional campaign promotion process, the Client has the right to request a total of two (2) corrections of materials, including changes in wording, phrasing, design elements, etc., as part of the main communication message and creative direction provided by NPLOY.NET under the 'Partner' subscription.

7.8
Alternative Creative DirectionIn the event that the Client does not approve either of the two creative directions proposed by NPLOY.NET for the promotional campaign included in the 'Partner' subscription, the Client shall be obligated to provide an alternative creative direction to be used as part of the promotional campaign.

Liability and termination
8.1.
 In the event of late or non-payment of amounts due for Services, NPLOY.NET has the right to: (a) restrict your access to theServices; (b) terminate the Agreement and your account.

8.2. 
NPLOY.NET may block your account in the event of: (a) suspected violations of the law, these Terms, or any other terms set forth on the Site; (b) at your request.

8.3. 
NPLOY.NET may terminate this Agreement and your account: (a) in the event of a long period of non-use of the account for more than 3 / three / years; (b) with reasonable notice in the event of termination of the Site; (c) in other cases provided for in the Terms or the law.

8.4 
NPLOY.NET is not liable for damages and lost profits suffered by you or third parties as a result of the execution of orders of the competent state authorities.

8.5. 
Except in case of intent or gross negligence, NPLOY.NET shall not be liable for damages and lost profits that have occurred:(a) as a result of use or inability to use the Site and / or the Services; (b)due to the restriction, termination or blocking of your account and / or your content in accordance with these Terms.

8.6. 
In all cases, the liability of NPLOY.NET in connection with the provided Service on the Site is limited to the amount of the price paid by you for the specific Service, unless otherwise provided by applicable law.

Changes in the Terms and the Services offered
9.1. 
To the extent that the Services provided by NPLOY.NET are diverse and constantly developed and supplemented, as well as in connection with legislative changes, NPLOY.NET reserves the right to add new Services, change or remove existing Services without the need for notice.

When making changes to the Terms, NPLOY.NET brings these changes to your attention by posting them in a prominent place on the Site or in your account. Changes to the Terms will not affect the provision of Services requested and paid for before the change.

In the event that you use the Services after the changes in the Terms take effect, they are considered binding on you.

In the event that any of the clauses of these Terms proves to be invalid, this will not entail the invalidity of the concluded contracts or other clauses.

Disputes under these Terms will be resolved by the competent Bulgarian court in Sofia.

The legislation of the Republic of Bulgaria shall apply to unsettled issues.

Technical and org measures

Information
This document contains the technical and organisational measures in connection with the Services provided by NPLOY.NET and is an integral part of the data processing policy and the Terms. In order to protect personal data, NPLOY.NET applies technical and organisational measures (in terms of personnel, buildings, software, hardware, networks, encryption, control, reporting and monitoring, vulnerability checks, etc.) against unauthorised or accidental access, loss , change, disclosure or destruction of data in accordance with the risks and impacts.

Protection of personal data
The employer is the only Data Administrator in his account. NPLOY.NET in its role of Processor will treat the data of the Employer as confidential, and will process them only in connection with and to the extent necessary for the provision of the Services or other cases provided in the Terms and the Policy.

Privacy Policy
2.1. When processing data, NPLOY.NET will apply security policies in accordance with the requirements of the law and good practices, in order to ensure the confidentiality, integrity and availability of data.

2.2. In order to determine the adequate level of technical and organisational measures and the admissible type of protection, NPLOY.NET performs an analysis of the impact on the processed personal data in its role of Processor.

2.3. In order to ensure effective protection, policies will be reviewed regularly, with a comprehensive review at least once a year.

2.4. All NPLOY.NET employees are required to apply these policies and practices in their work. Employees are informed of any changes in a timely manner and are required to review all policies at least annually.

2.5. NPLOY.NET will carry out checks when hiring new employees within the framework provided by law.

2.6. NPLOY.NET employees will receive training related to security and protection of personal data, in accordance with their position at least once a year.

Security incidents
3.1. NPLOY.NET will implement a documented action plan for security incidents and in accordance with the notification requirements of the Regulation.

3.2. NPLOY.NET will investigate all potential incidents and implement an action plan. In the event that the Employer suspects a vulnerability or security incident, it is necessary to notify NPLOY.NET immediately.

3.3. NPLOY.NET will notify immediately (but not later than 24 hours) in case of a breach of security of information of the Employer, and will provide, as far as possible, information about the incident and the actions taken.

Physical protection and access control
4.1. NPLOY.NET will use collocation centers with physical access control, including an up-to-date list of access rights and a log of visits.

4.2 NPLOY.NET will use collocation centers with uninterruptible power supply, air conditioning and protection against fire, theft and vandalism.

4.3. NPLOY.NET will control access to its offices, allowing only authorized persons and persons with an authorized escort. NPLOY.NET will apply technical measures such as electronic access control system, security system, etc.

Information systems and networks
5.1. NPLOY.NET will support a documented infrastructure architecture. NPLOY.NET will review the architecture, including security measures, and apply good segmentation and isolation practices. In case of use of wireless networks, they will be encrypted, will use reliable authorization and will not have direct access to networks directly connected to the Services. Services-related networks will not use wireless technology.

5.2. NPLOY.NET will store the data of the Employer logically separated from the data of the other Employers.

5.3. NPLOY.NET will apply encryption when transmitting data over public networks, using technologies such as HTTPS, Force-TLS for encrypted data transfer via email (applicable if you use email features) and others.

5.4. NPLOY.NET will implement solutions for key management, encryption and pseudonymization of stored data depending on the level of risk in the respective activity.

5.5. When managing the access of its employees, NPLOY.NET will give the minimum necessary rights for the performance of official duties or a specific assigned task, requiring the respective access, only for the period for which it is necessary.

5.6. NPLOY.NET will apply good practices for using passwords, cryptographic keys, session management, accounts and more.

5.7 NPLOY.NET will use a set of software and hardware solutions to protect and monitor and audit the security of the Services (Web Application Firewalls, Network Firewalls, Key management and encryption devices, SIEM, etc.) and end devices as security solutions. from viruses and malware, software updates, encryption, etc.

5.8. If applicable, NPLOY.NET will sanitise physical media intended for reuse or, if such use is not planned, will destroy them using good practice.

Security, continuity and availability
6.1. NPLOY.NET will conduct automatic and / or manual intrusion and vulnerability tests periodically and when deploying new or modifying existing applications, systems and networks.

6.2. At least once a year and / or in the event of significant changes, NPLOY.NET will conduct penetration and vulnerability testing of applications, systems and networks, including through ethical hacking, performed by an independent third party with adequate experience and reputation.

6.3. NPLOY.NET will support change risk management policies and procedures. Prior to implementing changes to applications, systems and networks, they will be documented in a change request, including a description, reason for the change, schedule, risk and impact assessment, expected outcome, rollback plan and documented approval by an authorized person.

6.4. NPLOY.NET will maintain a list of information systems related to the provision of the Services and will monitor their status.

6.5. NPLOY.NET will periodically evaluate the information systems related to the provision of the Services in terms of security, continuity and availability.

6.6. NPLOY.NET will ensure the backup of the Employer's data, ensuring that at least one copy is stored separately from the main system. The archives will be stored in encrypted form. NPLOY.NET will test their condition and recoverability.

6.7. In addition to scheduled updates to software, applications, systems, and network devices, NPLOY.NET will apply partial patches as needed after assessing feasibility and risk.

Appendix
7. In addition, NPLOY.NET undertakes to implement organizational and technical measures in accordance with the recommendations and opinions of the CPDP.

7.1. Physical protection.
NPLOY.NET undertakes to apply technical and organizational measures for the physical protection of personal data, including in applicable cases:
- identification of areas with controlled access,
- identification of the premises in which personal data will be processed,
- identification of the premises in which will be located the elements of communication and information systems for personal data processing,
- determining the organization of physical access, determining the mode of visits,
- determining the technical means used for physical protection, - determining a team to respond to violations.

Using: locks; cabinets; metal crates; equipping the areas with controlled access; equipment of the premises; physical access control devices; security and / or security system; perimeter protection devices; fire extinguishers; fire alarm and fire extinguishing systems.

7.2. Staff. NPLOY.NET undertakes to apply organisational measures to individuals who process personal data under its leadership, including:
- knowledge of the regulations in the field of personal data protection,
- knowledge of the policy and guidelines for personal data protection,
- knowledge on the dangers to the personal data processed
- on the sharing of critical information between staff (eg identifiers, access passwords, etc.)
- consent to the non-disclosure of personal data
- training
- training of staff to respond in the event of data security threats.

(a) To apply measures guaranteeing access to personal data only to persons whose official duties or specifically assigned task require such access, in compliance with the principle "Need to know"..

(b) Oblige the persons, before processing personal data, to be acquainted with:
- the regulations in the field of personal data protection,
- the instructions and guidelines for personal data protection,
- the dangers for the processed personal data.

(c) The persons who process personal data under his supervision are obliged to sign a declaration for non-disclosure of personal data, to which they have received access during and on the occasion of fulfilment of their obligations.

7.3. Documentary. NPLOY.NET undertakes to apply a system of organisational measures in the processing of personal data on paper, including:
- determination of the registers that will be maintained on paper,
- determination of the conditions for processing personal data,
- regulation of access to registers,
- control of access to registers,
- determination of storage periods, rules for reproduction and distribution,
- destruction procedures, procedures for verification and control of processing.

7.4. Information systems and networks.
NPLOY.NET undertakes to implement technical and organisational measures for the protection of information systems and networks, including in applicable cases:
- personal data protection instructions, protection manuals and standard operating procedures,
- definition of roles and responsibilities, identification and authentication ; registry management; session controls;
- external connections / connectivity; telecommunications and remote access;
- surveillance;
