Terms and Conditions for NPLOY.NET Job Board

These Terms and Conditions (“Terms”) govern the use of the nploy.net job board (the “Platform”). The Platform connects employers with job-seeking talent worldwide. By using the Platform, you agree to these Terms, which are divided into two sections: (1) Employer Terms &Conditions and (2) Talent (User) Terms & Conditions. The Platform’s Privacy Policy and Cookie Policy are incorporated by reference, meaning that by agreeing to these Terms, you also agree to the terms of our Privacy Policy and Cookie Policy​.

We adhere to the EU General Data Protection Regulation (GDPR) and other applicable data protection laws globally in processing personal data. Please read these Terms carefully. If you do not accept them, do not use the Platform.

Please read this document carefully. It contains the Terms of Access to and Use of the Mobile Application of www.nploy.net (the “Terms”). If you do not accept the Terms stated here, it is not possible to use the Site! Use of the Services available without registration will be deemed to be an expression of consent to these Terms. In connection with the Services provided, NPLOY.NET processes personal data in accordance with the Privacy Policy ("Policy"), which you can read here. The policy is an integral part of these Terms. Conclusion of a contract

By clicking on the "Registration" button and confirming the registration email you have received, you make an electronic statement by which you enter into a contract with Us under these Terms and undertake to comply with them. Before clicking the "Register" button, you have the opportunity to view and edit the information you provided. You accept that the electronic statements to NPLOY.NET and the electronic statements from NPLOY.NET to you will be considered signed with a simple electronic signature in accordance with Art. 3 (10) of Regulation (EU) № 910/2014, by hand signature. The authorship of these statements will be established by the order of art. 13, para. 1 in connection with art. 13, para. 4, assoc. 2nd of the Law on Electronic Document and Electronic Certification Services (“ZEDEUU”).

1. Employer Terms & Conditions

The following terms apply to Employers (companies, recruiters, or other organizations posting jobs or searching for talent on the Platform). By registering an Employer account or using any Employer features, you agree to these Employer Terms & Conditions.

1.1 Provision of Accurate Company Information
Employers must provide valid, accurate, and up-to-date information about their company and job openings at all times. This includes the company’s legal name, contact details, industry, location, job descriptions, requirements, and any other content you post on the Platform. Your epresent and warrant that all information and content you submit is truthful, accurate, and not misleading​. If any information changes or you discover any inaccuracy, you agree to promptly update the information. The Platform relies on the accuracy of Employer-provided content and may remove or require correction of content that is found to be false or that violates these Terms​. Employers are solely responsible for the content they publish; the Platform does not guarantee the accuracy or legitimacy of Employer content to Users.

1.2 Posting Jobs and Storage of Job Information
When an Employer posts a job opening on the Platform, the job ad and all its details(including any embedded media or logos) will be stored by the Platform and made publicly visible to relevant candidates. The Platform may edit or translate certain field entries for consistency, clarity and/or reach, or refuse to publish any job ad that violates these Terms or applicable law. Job ads typically remain live for the purchased duration (e.g. 28-30 days for a standard listing) and then expire or are archived. The Platform may retain copies of job postings for a limited time after expiration for record-keeping, analytics, or to facilitate re-posting, in accordance with our Privacy Policy. The platform simply provides a venue for Employers to advertise positions and for candidates to apply​and employers are responsible for ensuring their job postings comply with all applicable laws (such as labor laws, equal opportunity laws, etc.) and do not discriminate unlawfully​.

1.3 Access to Talent Data and GDPR Compliance
Application Data Access: When a candidate (“Talent”) applies to an Employer’s job posting or other wise shares their profile with the Employer via the Platform, the Employer will gain access to certain personal data of that candidate (such as the candidate’s name, CV/resume, work experience, skills, contact information, mobile number, email address and any application answers) through the Platform​. Employers agree to use such candidate data only for recruitment and hiring purposes. Access to candidate personal data via the Platform is time-limited for privacy compliance: application materials and unlocked candidate profiles will be visible to the Employer in their account for a maximum of six (6) months, unless the candidate renews their consent or an applicable law permits longer retention​. After six months from the time of the candidate’s application or profile unlock, that candidate’s personal data maybe automatically hidden or deleted from the Employer’s account in order to comply with data retention policies and GDPR requirements​. Employers must download or note any needed data within that period and should not retain or process a candidate’s personal data beyond that period unless they have obtained direct consent from the candidate to do so. The platform holds no accountability regarding any use of candidate data outside of the platform and outside of the mentioned time-period.

Data Protection and Use: Employers agree to treat any personal data of candidates obtained through the Platform as confidential and to handle it in compliance with all applicable data protection laws, including GDPR. This means, among other things, you will not disclose candidate data to unauthorized parties, will store it securely, and will not use it for purposes outside of evaluating the candidate for employment. You will not retain candidate CVs, contact details, or other personal information longer than necessary for recruitment purposes, and you will honor any request by a candidate to delete or return their data (for example, if a candidate withdraws an application or requests erasure under GDPR). The Platform may also implement technical measures to ensure data is only available for the permitted timeframe (such as automatic deletion or anonymization after 6 months). Employers shall cooperate with the Platform in ensuring GDPR compliance; for instance, if we inform you of a candidate’s request related to their data or of any need to delete data, you will promptly comply. Note: The Platform maintains a log of application transmissions for at least one year as required by law (this log includes the fact that an application was sent, along with sender and recipient identifiers, but not the content of the application)​. This log is kept by NPLOY.NET for legal accountability and will be purged after one year, subject to any legal holds.

Intermediary Role of Platform: The Platform acts as an intermediary in the exchange of information between Talent and Employers. Until a candidate applies or consents to share their profile, Employers cannot access personal details of any individual candidate. If the Platform offers a feature where Employers can proactively show interest in candidate profiles (Talent Pool feature, see 1.4 below), the candidate’s full profile may only become visible if the candidate reciprocates interest or explicitly allows the Employer to see it​. This safeguard is in place to protect candidate privacy. Employers understand that some communications or data exchange may be facilitated by the Platform on their behalf (for example, sending an interview request via the Platform’s messaging system), and that the Platform may monitor or record such communications for compliance and support purposes. Any processing of personal data by the Platform on behalf of Employers is done in accordance with GDPR Article 28 (the Platform as a data processor) and our Privacy Policy. The Employer, as data controller for any candidate data they receive, is responsible for compliance with controller obligations (such as responding to access or deletion requests from candidates).

1.4 Talent Pool and Contact Credits
Employers may have access to a “Talent Pool” or candidate database for proactive recruiting. This service allows Employers to view limited profile information of potential candidates and use credits to initiate contact or invite candidates to apply for a job. Talent Pool Credits enable an Employer to send an invitation for job application to a candidate profile through the Platform’s interface​. Employers acknowledge that using a credit to invite a candidate to apply does not guarantee that the candidate’s full personal data (such as direct email, name or phone number) will be revealed to the Employer. The Platform may relay messages or invitations to the candidate on the Employer’s behalf, and the candidate can choose whether to respond or share more information. In other words, Talent Pool credits facilitate communication but do not automatically provide the candidate’s contact details unless the candidate consents. This ensures privacy is maintained while enabling Employers to reach out. Employers agree to use these features solely for bona fide recruitment purposes – for example, inviting a candidate to consider a specific job opportunity – and not to spam candidates or attempt to circumvent the Platform’s messaging system to obtain personal data. Any personal data that is received through a Talent Pool interaction (e.g.,if a candidate is interested in the job and applies for it) must be handled in accordance with Section 1.3 (Data Protection and GDPR compliance) above.

1.5 Product Offerings and Purchase of Services
Employers can purchase various recruitment products and services on the Platform, as described on our website (see our Pricing page for details of current offerings). Available products may include, for example: single job postings, packages or bundles of multiple job ads, Talent Pool (proactive search) credits, subscription plans, employer branding campaigns, recruitment marketing services, and others. All product purchases are subject to these Terms as well as any specific terms presented at the time of purchase (such as pricing, quantity, and duration). By purchasing a product or service, the Employer agrees to pay the advertised fees and abide by any usage limitations or guidelines associated with that product. The Platform will deliver the purchased services as described: for instance, publishing job ads for the specified duration, or providing access to invite a certain number of candidates to apply. While the Platform will use reasonable efforts to promote job ads (including via AI matching to relevant candidates) and maintain service availability, no guarantee is made that any particular product will yield a specific outcome (such as a certain number of applicants or hires), and no employment outcome is promised

Validity of Credits and Services:
Unless otherwise stated, any job posting credits or Talent Pool credits that an Employer purchases are valid for a period of one(1) year from the date of purchase​. Credits or services not used within their validity period will expire. For example, if you buy a bundle of job ads or talent pool credits, you must use them (i.e. post jobs or invite candidates) within one year; after that time, unused credits are forfeited. Credits are not refundable or redeemable for cash.

No Refunds Policy:
All purchases of NPLOY.NET services are final. Fees paid for job ads, subscriptions, credits, employer branding, marketing campaigns or any other services are non-refundable, except where required by law or expressly stated otherwise in writing​ by NPLOY.NET representatives. Once a service or credit is purchased, the Employer is not entitled to a refund or credit for any unused portion of the service. For example, if you purchase a monthly subscription or a package of postings and then choose to stop using the Platform or remove a job ad early, you will not receive a refund for the remaining time or unused posts. Similarly, if you purchase an employer branding service or recruitment marketing budget and do not use the entire budget or service, the unused amount is not refunded. This no-refund policy applies to partial use of services as well​.The Platform, in its sole discretion, may consider refund requests in extraordinary cases (such as a clearly documented technical failure on our side that prevented use of the service), but generally any refunds or credits are issued only at the Platform’s discretion and as a courtesy. Charge backs or payment disputes initiated by the Employer without first attempting to resolve with NPLOY.NET may result in immediate suspension of the Employer’s account.

Recurring Subscription Payments:
If an Employer purchases a subscription plan (for example, a monthly or annual plan for a certain number of job listings, job scraping and aggregation services from career websites, or continuous access to the Platform’s services), the Employer agrees to automatic, recurring billing. By entering your payment information and purchasing a subscription, you authorize the Platform or its payment processor(e.g. Stripe) to charge your provided payment method the applicable subscription fees on a recurring basis (e.g. monthly) until you cancel. The billing will occur on or about the same day each billing period as the date of your initial subscription purchase. Subscription Cancellation: You may cancel a subscription at any time to prevent future renewal charges​.Cancellation can typically be done by contacting support via email to office@nploy.net or by contacting your account manager. If your payments are processed via a third-party payment gateway (such as Stripe), you may also cancel through that service’s interface or by request to us. When you cancel, your subscription will not renew for the next period, and no further charges will be made. You will continue to have access to the subscribed features until the end of the current paid period. The Platform does not impose any penalty or additional fee for valid cancellations—cancelling is hassle-free and takes effect at the end of your current billing cycle​. However, no pro-rated refunds are given for the remaining period in a billing cycle after cancellation (e.g., if you cancel mid-month, you won’t get a refund for the rest of that month)​. To avoid being charged for the next period, you should cancel before the renewal date. The Platform may, in its discretion, send you a reminder about upcoming renewal or provide an auto-renewal notice as required by law, but it remains your responsibility to manage your subscription. We reserve the right to change subscription fees with at least 30 days’ notice to you (you will have the opportunity to cancel before new rates apply).

1.6 Company Profile and Branding License
Profile Enrichment: As part of operating the platform, NPLOY.NET may help create or enhance the Employer’s company profile on the Platform. This could include importing or adding publicly available information about the company (such as company size, industry, logo, website URL, social media links, and a general description, web data such as ratings of the company and others) to the profile, for the benefit of attracting candidates and providing a more detailed and useful information to applicants. The Platform might gather this information from the company’s own website, public business directories, or other legitimate web sources. The Employer will have the opportunity to review and edit any information on their company profile. If any automatically added information is inaccurate or the Employer prefers not to display it, the Employer can edit or remove it at anytime, or request the Platform’s support team to do so. Our goal in enriching profiles is to provide candidates with a fuller picture of the Employer. We do not collect confidential or sensitive company data for profile enrichment- only public or Employer-provided content. In some cases, with Employer authorization, we might integrate with the Employer’s own systems or use scraping tools to import job listings or other data (for example, pulling current open roles from the company’s career page or ATS to post on the Platform)​.Any such integration will be done in compliance with the Employer’s instructions and applicable law.

Use of Company Name and Logo: By using the Platform and providing your company’s branding elements (such as company name, trademarks, and logos) on your profile or job postings, you grant NPLOY.NET a worldwide, royalty-free, non-exclusive license to use those names and logos for the purpose of operating and promoting the Platform’s services​. This means the Platform may display your company name and logo on job listings, search results, online distributed content, ads, and other parts of the site or app to indicate that your company is hiring. We may also feature your company as a participant on the Platform in our marketing materials, such as a client list, case studies, or promotional content, for the purpose of highlighting the opportunities available (for example, showing your logo among “Top Companies on NPLOY.NET”)​. Any such use will be in accordance with our brand guidelines and will be intended to benefit both the Employer and the Platform’s user community(e.g., giving your jobs more visibility). We will not substantially alter your logo or trademarks except to resize or format them for display. You retain ownership of your trademarks and logos, and can withdraw permission for marketing use by contacting us with a request (allow us a reasonable time to remove references in future materials). However, basic usage within the Platform (showing your company name and logo on your job posts or profile) is necessary for the service and will continue as long as you have active postings. The Employer confirms that it has the rights to grant this license for all content (logos, images, text) that it uploads or that we enrich the profile with, and that such use by the Platform will not infringe any third-party rights. The Platform relies on the Employer’s representation of having rights to their content​

1.7 Cookies and Employer Communication
Cookies and Tracking Technologies:
The Platform uses cookies and similar tracking technologies to provide and improve our services. When Employers or their representatives use the Platform (whether via web or the employer portal), cookies will be placed in accordance with our Cookie Policy. These cookies may remember login sessions, preferences, and track usage for analytics. By using the Platform, you consent to our use of cookies as described in our Cookie Policy​. You may manage cookie preferences through your browser settings; however, disabling certain cookies may affect functionality (for example, remaining logged in or seeing tailored content). For more details on what cookies we use and why, please refer to our Cookie Policy (which includes information on opting out of analytics or advertising cookies, if applicable).

Email and Notification Preferences: By registering as an Employer on the Platform, you agree that we can contact you via the email address (and/or other contact information) you provide for essential communications related to the service​. These communications include, for example: account confirmations and verifications, billing invoices and receipts, notifications of job post status (approvals, expirations), candidate application alerts, and important service announcements (such as updates to terms or privacy policy, security alerts, or changes to features). We may also send you periodic product updates, newsletters, or promotional offers addressing Employers. For instance, we might email you about new features relevant to recruiters, special promotions, or tips for getting more candidates. We will only send marketing or promotional communications to your designated contacts in accordance with applicable anti-spam laws. All marketing emails will provide a clear way to unsubscribe or opt out of future promotional messages​. You can opt out by clicking the “unsubscribe” link in the email or adjusting your notification settings in your Platform account. Opting out of marketing communications will not affect our ability to send you transactional emails that are non-promotional (for example, you will still receive an email if a candidate applies to your job or if your subscription payment failed, etc., as these are considered necessary service communications).

Use of Third-Party Communication Tools: You acknowledge that NPLOY.NET may use third-party service providers to send communications (emails or SMS) to you and to your team. For example, we might use an email delivery service to send out our newsletters or a SMS gateway to send text messages. These communications may therefore involve routing your contact information through those third-party systems. We ensure that any service providers we use are bound by confidentiality and data protection obligations (under GDPR “processor” agreements where applicable) to safeguard your information. By using the Platform, you consent to this use of third-party processors for communication. While we strive for timely and reliable communication, the Platform does not guarantee the availability or successful delivery of any email or notification, as delivery can depend on factors outside our control (such as your email server, internet service provider, or phone carrier)​. The Platform is not responsible for any delays or failures in receiving communications, but we will do our best to notify you through alternate means if we become aware of widespread issues. If you need assistance with communication preferences or suspect you are not receiving necessary messages, please contact our support.

1.8 Employer Conduct and Liability
Prohibited Uses:
Employers agree to use the Platform solely for lawful, legitimate recruitment purposes. You must not misuse the Platform by posting false jobs, misleading information, or any content that is illegal, harassing, or violates anyone’s rights. You will not scrape or data-mine the candidate data base outside of provided tools, and you will not share access to the Platform with unauthorized parties. You will not attempt to circumvent Platform systems (for example, soliciting candidates to apply outside the Platform just to avoid using credits, or bypassing privacy features to obtain direct contact info without consent). Further, you agree not to discriminate against candidates in violation of law or Platform policies, and not to ask candidates for sensitive personal data that is not relevant to the hiring process (unless allowed bylaw). The Platform reserves the right to remove any job post or content that violates these rules or receives substantiated complaints, and to suspend or terminate any Employer account for serious or repeated misconduct.

No Warranty for Results: NPLOY.NET does not guarantee that you will find a suitable candidate, fill a job vacancy, or achieve any particular outcome through the Platform. We do not guarantee the number or quality of applicants, nor the suitability of any candidate who might apply. Any hiring decisions you make are solely your responsibility, and you assume all risks related to interacting with candidates. The Platform simply provides tools and exposure for your job openings. We do not verify independently the truth or accuracy of candidates’ profiles, resumes, or their ability to perform job duties. While Users are required to provide truthful information and we may perform certain checks or moderation, you should conduct your own due diligence (such as interviews, reference checks, assessments) before hiring​.The Platform makes no representation regarding candidates’ identity, eligibility to work, qualifications, or background.

Employer’s Liability: You, as an Employer, agree that you are solely responsible for your interactions with candidates and any hiring decisions or employment relationships that result. Any employment contract or arrangement is strictly between you and the candidate; the Platform is not a party to it and has no obligations or liabilities arising from it​. You agree to indemnify and hold harmless NPLOY.NET and its affiliates from any claims or liabilities arising out of your job postings, your recruitment practices, or your employment of any candidate, except to the extent a claim is directly caused by the Platform’s breach of these Terms. For example, if a candidate alleges that an Employer’s hiring process was discriminatory or that a job posting was unlawful, the Employer will be responsible for handling such dispute and any associated costs. The Platform may choose to assist in mediating issues but is not obligated to do so.

Platform Liability Limitations: To the maximum extent permitted by law, the Platform’s liability to Employers for any matter arising from these Terms or use of the Platform is limited. NPLOY.NET will not be liable for indirect or consequential damages, loss of profit, loss of data, or business interruption. Direct damages (if any) will be capped at the total fees paid by the Employer to the Platform in the three (3)months prior to the event giving rise to the claim. Note that in some jurisdictions, certain warranties or liabilities cannot be excluded or limited; we do not exclude those if applicable. However, in general, the Platform is provided “as is” and “as available” without warranties of any kind, and we do not guarantee error-free or uninterrupted operation of the service.

2. Talent & Candidate (User) Terms & Conditions

The following terms apply to individual users of the Platform who are seeking employment or networking opportunities (“Talent”, “Job Seekers”, or simply “Users”). By creating a Talent account or using the Platform’s job search and application features, you agree to these Talent Terms & Conditions.

2.1 User Registration, Eligibility, and Consent
In order to use the Services, you guarantee that you have reached the age of 18 and are capable of concluding a contract. NPLOY.NET is not responsible in case of use of the Services by a person who does not meet the specified age and legal capacity restrictions.

The use of part of the Services is possible only with registration. The registration is done in person, and registration on behalf of other persons is not allowed. Upon registration you are required to fill in the required fields in the registration form (name, email address, etc.). You declare that you meet the requirements of item 2.1.

By using the Platform, you consent to these Terms and to our Privacy Policy and Cookie Policy​. When you first register, you will be asked to acknowledge these Terms. If you do not agree, you should not proceed with registration or use the Platform. By registering, you affirm that you have reached the age of majority or are otherwise legally authorized to form a binding contract in your jurisdiction​. The Platform is not liable for any misrepresentation of age.

Account Security: You are responsible for maintaining the confidentiality of your account login credentials and for all activities that occur under your account​. If you suspect any unauthorized access to your account, you must notify NPLOY.NET immediately. You should use a strong, unique password and enable any available security features (such as two-factor authentication) to protect your account. We may communicate with you via the email or other contact information you provide for account-related matters, and you agree to such communications as part of using the service​.

2.2 Personal Data and Privacy Protection

Data Collection and Storage:
When you use the Platform, we will collect and store certain personal data about you to facilitate job matching. This includes information you provide in your profile and job applications (such as your name, contact details, work experience, education, skills, resume/CV, etc.), as well as data we generate (e.g., your activity logs, match scores) or obtain from third parties with your consent (e.g., if you import data from LinkedIn or upload a resume for parsing). By using the Platform, you agree that we may process your personal data for the purposes of providing our services to you and improving them, in accordance with our Privacy Policy and applicable laws. We implement appropriate technical and organizational measures to protect your data. We will not share your personal data with employers or third parties except as described in these Terms and our Privacy Policy.

Consent to Store and Process Data: You explicitly consent that the Platform may store your profile information and any resumes or files you upload on our servers. We will retain this data until you delete it or your account, or otherwise as needed to provide the service and as permitted by law. If you choose to close your account (or if it’s terminated due to inactivity or breach), the Platform will delete or anonymize your personal data, except for any data we are required to keep for legal reasons or legitimate business purposes for a limited time (for example, logs of transactions or communications may be kept for a period, typically not more than 1 year, to comply with legal obligations and resolve disputes)​. Please refer to our Privacy Policy for details on data retention periods. If you want us to remove your data sooner (such as after you’ve found a job and no longer want your profile on the Platform), you have the right to request deletion. Note that if you have actively applied to jobs, the employer who received your application may retain a copy of your information in their own systems; In such cases, we always communicate with such employers your request for deletion, however the Platform cannot force employers to erase your data from their records, so you may need to contact the employer directly for that. However, within the Platform, we will cease to disclose your data to any employers once you delete it or delete your account.

Cookies and Usage Data: The Platform uses cookies and similar technologies to enhance your experience (for example, keeping you logged in, remembering your preferences, and providing personalized job recommendations). By using the Platform, you agree to our use of cookies as outlined in our Cookie Policy​. You can control cookies through your browser settings, but essential cookies are necessary for the Platform to function properly. We also collect usage data such as device information and log data (e.g., IP address, browser type, pages visited) for security and analytics. For more information, see our Privacy Policy. By continuing to use the Platform, you acknowledge our data practices. If you do not consent to these practices, please discontinue use and delete your account.

2.3 Profile Information and User Obligations

Accuracy of Information:
Users are expected to provide truthful, accurate, and complete information in their Platform profile and in any job application. You certify that all information you enter – including your name, contact details, qualifications, employment history, education, skills, and any other details – is correct and corresponds to reality​.  Providing false information (for example, claiming a degree or certification you do not have, or using a pseudonym that isn’t your legal name without clarification) is a serious breach of these Terms and can lead to suspension or termination of your account. It can also harm your chances of employment and could have legal consequences. The Platform and Employers rely on the accuracy of the information you provide​; therefore, you agree to promptly update your profile if any information changes or needs correction. For instance, if you gain a new skill or job experience, or if you change your phone number, you should update your profile to keep it current. The Platform may allow you to attest or verify certain information (such as linking to a certification or performing an ID verification). If you cannot verify requested details, you may be restricted from certain features. We reserve the right to remove or hide any part of your profile that we believe is false, misleading, or violates these Terms or the law.

User Conduct: As a Talent user, you agree to use the Platform professionally and respectfully. You will not misuse the Platform by uploading inappropriate content (e.g., offensive language or images in your profile), harassing or spamming other users or employers, or attempting to undermine the platform’s integrity (such as by hacking, interfering with other’s profiles, or scraping data without authorization). You will only apply to jobs for which you have a genuine interest and, to the best of your knowledge, meet the basic qualifications. You will not use the Platform to advertise services or do anything unrelated to job seeking (no commercial solicitation or marketing of your own through your profile). You will use features enabling communication with employers (like messaging or interview scheduling), solely for professional communication about job opportunities. Any misuse can result in disciplinary action, including account termination.

2.4 Applying to Jobs and Data Sharing with Employers

Application Process:
The Platform provides various ways for you to express interest in a job – such as clicking “Apply”, swiping jobs right, submitting your profile or resume, or responding to an employer’s invite. When you apply for a job through the Platform, your application (including the personal information and documents you provide) is transmitted to the Employer hosting that job​. In many cases, this is done by directly placing your information into the Employer’s account on NPLOY.NET for that job posting. In other cases, the Platform may redirect you to an external application process (for example, if the employer’s listing requires you to apply on their corporate site. But for the majority of on-platform applications, by clicking apply and confirming, you are giving the Platform consent to share your personal data with that specific Employer for the purpose of evaluating you for the job​. The information shared typically includes the details in your profile, your resume, your name and contact info, and any answers to application questions or cover letters you submit. You understand and agree that once this data is passed to the Employer, the Employer becomes a controller of that data in their own right and is responsible for how they handle it. The Platform requires Employers to treat your data lawfully (see Employer Terms above), but cannot absolutely control their actions. By applying, you consent to this transfer of your data to the Employer. If you do not want an Employer to have your information, do not apply to their job.

Employer Access and Follow-Up: After you apply, the Employer may view your application within their Platform dashboard or downloads. The Platform will provide mechanisms for the Employer to contact you, such as sending you a message or an interview request through the Platform. In some cases, an Employer might receive anonymized or masked contact information for you (for instance, an email relay address) to communicate without immediately revealing your direct contact details, until you choose to respond or engage. Typically, your detailed profile is only revealed to an employer after a mutual interest or a direct application​. If you apply or show interest in a job, the employer might see a limited preview of your profile (e.g., job title, skills, location) but not full personal details until they approve you for the job. This is part of our privacy safeguards, ensuring that your info is shared in a controlled manner​. If you receive a message or interview invitation through the Platform, you will be notified via the Platform and by email or push notification. It is your responsibility to respond in a timely manner. The Platform may send reminder notifications as a courtesy​, but cannot guarantee delivery (see Communications section below). Keep in mind that the Employer, once in possession of your CV or contact info, might also reach out to you outside the Platform (e.g., calling you for an interview). The Platform is not responsible for external communications between you and the Employer.

Talent Pool and Match Requests: After registering and creating your profile with NPLOY.NET, you understand and agree that your professional profile would be searchable and discoverable in our “Talent Pool” section, which is provided to some Employers for proactive recruitment. Some employers with access to the Talent Pool will be able to find your profile, based on their search and view your professional experience. The Talent Pool never shows your personal and contact information to any employers. Your discoverable profile in the Talent Pool / Database is fully anonymized and Employers cannot see your personal information, such as name, email and phone number. Employers, based on your anonymized profile, can send you ‘Match requests’ or invite you to apply to a specific job they are hiring for, if they think your experience is a good match. After an Employer sends you an invitation to apply for a job, we will notify you via email, push notification and SMS / text message about the interest of the employer towards your profile. You can opt-out of such communication at any time – read more in section 2.5 below. If you also show interest towards the job invite (if you apply to this job), then your personal information (name, email and phone number) would be unlocked to the employer and they will gain access to this information. Personal information is unlocked for employers interested in your profile only after you explicitly apply to their position.

No Guarantee of Employment:
Submitting applications or interviewing through the Platform does not guarantee that you will receive a job offer or even a response from the Employer. The Platform is not an employment agency and does not have control over the hiring decisions of Employers​. We facilitate connections but the outcome is up to you and the Employer. The Platform does not guarantee that job listings are still open or that employers will review your application. (However, we do encourage employers to manage their postings responsibly and to close listings that are filled.) If you suspect that a job posting is fraudulent or an employer is misusing your data, please notify us immediately. We take reports of misuse seriously and may intervene or remove content as appropriate.

2.5 Communications and Notifications to Users

By creating an account, you agree that NPLOY.NET may send you communications regarding your account, job opportunities, and the Platform’s services. These communications can be via email, in-app notifications, push notifications on our mobile app, or SMS/text messages, depending on the contact information you provide and your notification settings. We outline below the types of communications you can expect and how to manage them:

Transactional and Service Communications: These are messages necessary for using the Platform and tracking your activities. They include: account verification emails, password reset messages, confirmations of job applications you submitted, updates on the status of those applications, messages from employers (e.g., interview requests or direct messages forwarded through our system), and other related notifications (such as alerts that an employer viewed your profile or that a job you liked has new activity). You cannot opt out of critical transactional emails because they are part of the service (for example, if you apply for a job and are approved). You may receive these via email and/or via push notifications if you have those enabled​. For courtesy notifications like “Your application was viewed” or “Reminder: You have an interview tomorrow,” you can usually control those in settings, but we consider them part of enhancing your job search.

Job Alerts and Recommendations: After registration, you agree that we will send you job alert emails or notifications that match your profile and preferences. For instance, you might receive a daily or weekly email with new job postings in your field or location, or a push notification when a highly matching job is posted. We might also notify you when an employer shows interest to your profile and invites you to apply to a job. These communications are meant to inform you of opportunities. You can manage preferences for job alerts (e.g., adjust frequency or unsubscribe) through your account settings or by contacting our support team at notif@nploy.net

Platform Updates and Newsletters: You agree that we may send you newsletters or general updates about the Platform, such as new features for job seekers, career tips, events (webinars, job fairs), or surveys for feedback. These are considered marketing communications. We will only send these if you have not opted out. You can unsubscribe at any time by clicking the link in the email or updating your communications preferences. We do not spam – typically, such emails are infrequent and focused on useful content. If you opt out of these, you will still get the essential messages described above.

SMS and Mobile Notifications: After completing your profile in NPLOY.NET and you provide a phone number, you agree to receive certain important communications via SMS. For example, you might get a text when an employer sends you a ‘match request’, or invites you to apply to one of their jobs. You could also receive a one-time PIN for login verification. By registering, you consent that you agree to receive SMS messages from NPLOY.NET, until you delete your account from the platform, or explicitly opt-out from SMS notifications. You can opt out of SMS / text message notifications at any time from the settings menu in the web platform and the mobile app, as well as by sending an email to our team with your intention at notif@nploy.net. After opting out, you might receive one final confirmation message and then no further SMS. Note that opting out of SMS will not affect communications via email, push notifications or in-app. Push notifications on the mobile app can be controlled via your device settings, as well as via the in-app settings; you can disable push notifications entirely or on a per-app basis if you no longer want to receive them​. If you keep them on, we’ll send push notifications for things like new matches, employer messages, match requests / job application invites, or reminders, similar to what’s described for email.

Summary of Typical Communications You May Receive: For clarity, here are examples of communications you consent to receive (depending on your activities):

- Account & Security: Signup confirmation, login alerts, password reset, 2FA codes.

- Application Updates: Confirmation of each job application sent; notifications when an employer views your application or if your application is progressed or rejected (if the employer updates status); interview invitations or scheduling requests.

- Direct Messages: If an employer uses the Platform’s messaging to contact you, we forward that message to your email and/or app inbox. You may also get alerts like “You have a new message from [Company].”

- Job Matches: Recommendations of new jobs that fit your profile, or alerts for jobs at companies you follow.

- Employer Interested: Notification that an Employer send you a match request and invited you to apply to a job (with the option for you to accept or decline).

- General Updates: Newsletter emails with career advice, or announcements of new Platform features (only if subscribed).Maintenance Notices: If there’s going to be downtime or an important update, we might notify you.

- Feedback Requests: Occasional survey or review requests to understand how we can improve.

These communications are provided as part of our service to enhance your job search experience​. While we strive to provide timely and helpful notifications, you should not rely solely on the Platform’s communications for critical matters. For example, if you accept an match request via the Platform, it’s wise to follow up proactively; do not assume the employer saw your acceptance just because you clicked a button – technical issues can occur​. Always double-check important arrangements directly with the employer if possible.

Opt-Out and Preference Management: You have control over many of these communications. In your account settings, you will find a Notifications or Email Preferences section where you can: select which types of email you want to receive, unsubscribe from job alerts or marketing emails, and manage push notification settings. Also, every marketing email will include an “Unsubscribe” link at the bottom – clicking that is an easy way to opt out of that specific type of email​. As noted, you cannot opt out of essential transactional emails (other than by discontinuing use of the Platform entirely, which would stop all emails because you have no activity). If you are receiving communications that you believe you did not consent to, please contact support so we can investigate. We comply with anti-spam laws (like CAN-SPAM, CASL, GDPR) regarding marketing emails, so we make sure to honor opt-outs promptly.

Third-Party Communication Services: NPLOY.NET may employ third-party services to send communications (e.g., an email service provider to send out our emails, or a text message gateway for SMS). By using the Platform, you agree to the use of such services, which might involve your contact information being handled by those providers for the sole purpose of sending the messages. Rest assured, we have data processing agreements in place with these providers to protect your information, consistent with our Privacy Policy. However, since these are external services (for example, if we send an SMS, the delivery depends on telecom carriers), we do not guarantee the delivery or timing of messages​. If a service is down or a carrier fails, you might not receive a notification. Always log in to your Platform account to check for any new messages or updates - your account dashboard will have the most up-to-date information on your applications and messages, regardless of email/SMS notifications​.

2.6 AI Processing and Automated Decision Making

NPLOY.NET uses technology, including artificial intelligence (AI) and machine learning algorithms, to enhance the services we provide to Talent users. By using the Platform, you acknowledge and consent to the following uses of your data in an automated manner:

Resume Parsing and Profile Suggestions: If you upload a resume/CV or import your work history, the Platform may use an automated resume parsing tool (potentially provided by a third-party AI service) to read and extract information from your document. For example, the parser will identify your name, contact info, past job titles, dates, education, skills, etc., and populate your profile with this data in a structured format. This saves you time in filling out your profile. The parsing process might involve sending your document’s text to an AI engine (for instance, a cloud service specializing in CV parsing) - by uploading your resume, you consent to this processing. The third-party processor will only use the data to return the structured result to NPLOY.NET and we do not allow them to retain or use your resume for other purposes. If you prefer not to have your resume processed by AI, you can opt to fill in your profile manually instead of uploading a file.

AI Matching and Recommendations:
The Platform’s core feature is to match you with relevant job opportunities. To do this, our algorithms analyze the information in your profile (skills, experience, location, preferences) and compare it with job requirements. We may also consider your activity (like which jobs you view or apply to) to improve recommendations. This is largely automated. For example, our system might calculate a “match score” for how well you fit a job, and we may prioritize showing you jobs with higher scores. Similarly, employers might see an algorithmic ranking of candidates who applied to their job. Any such automated ranking or recommendation is intended to be a helpful sorting tool not a final decision-maker. No automated decision by the Platform will prevent you from applying to any job or deny you use of the service – you are always free to apply to any job you see, even if the algorithm might have given it a low match score for you. The AI recommendations are provided “as is” without guarantee of accuracy​. We strive to continuously improve them, but you should use your own judgment too. If you feel a recommended job isn’t suitable, you can ignore it; conversely, check out jobs beyond just what is recommended. By registering you agree that our AI models will analyze your profile to show you the best matches in the platform.

Career Insights and Content Generation: The Platform might offer AI-driven insights such as suggested improvements to your profile (“Your profile is X% complete, add a summary for better visibility”) or even auto-generated portions of content with your permission (for instance, generating a draft cover letter or bio based on your CV using AI). Any AI-generated content will be presented for you to review and edit. You are responsible for reviewing any such content before using it. The Platform may also summarize aspects of your profile for employers (e.g., an AI-generated blurb highlighting your top skills) to save them time. We ensure that these summaries are based on your actual data and do not introduce false information. Nonetheless, you should treat them as suggestions and not absolute. If you spot any incorrect AI-generated information in your profile, you can edit or remove it. The AI tools we use (including any third-party AI like OpenAI or others) operate under licenses to us, and any content they produce through our service is considered part of the Platform’s services​. Users do not obtain any proprietary rights over the AI algorithms or outputs beyond their own profile content. We may limit or disable AI features for any user if we detect misuse or if required by law or policy.

Automated Decisions and User Rights: Under some data protection laws (like GDPR), users have rights regarding significant decisions made solely by automated means. We clarify that the Platform does not make any legally significant decision about a user purely by algorithms. We do use automation to filter and sort information (for example, to recommend jobs or to flag profiles that might match a search), but human decisions are involved in hiring processes (employers decide whom to interview or hire, not our AI) and in Platform moderation (our team oversees automated flags for policy violations, etc.). If you have any concerns that an automated process is affecting you in a significant way, please contact us. You have the right to request human review of any AI-driven decision that you believe negatively impacts you in a way that is more than trivial. For instance, if you think the system is erroneously hiding your profile or not showing you any matches due to a glitch, we will investigate and correct any unfair bias or error. We design our algorithms to be fair and without discrimination; inputs like race, gender, religion, or other sensitive attributes are not factors in our job matching algorithm (and in many cases we don’t even collect such data). We also regularly test our models to prevent disparate impacts. By using the service, you acknowledge that some personalization and matching is done by automated systems, and you consent to this. If you do not want any AI processing of your data, unfortunately you would not be able to use key features of the Platform (as they are integral to how it works), so your remedy would be to not use the Platform.

2.7 Disclaimers and User Liability

No Guarantee of Job or Content:
While the Platform strives to present genuine opportunities and useful career information, we do not guarantee the authenticity or validity of every job post or employer on the Platform​. We screen postings and employers to some extent, but users should exercise caution and common sense in the job search. If an employer’s communication or a job offer seems too good to be true or suspicious, be vigilant. The Platform is not liable for any fraudulent schemes that a user may encounter, but we do ask you report them, so we can take swift action. We disclaim any warranty that the job content (descriptions, company info, salary range, etc.) is accurate or up-to-date – that information is provided by the Employer or web data, not by us​. We also do not guarantee that the Platform will be error-free or uninterrupted, or that any particular feature (like a notification or application submission) will always function without flaw. We will, however, do our best to maintain the service and fix issues that arise.

User Responsibility: You are responsible for your interactions and decisions on the Platform. This includes the content you share and the actions you take. If you engage with an employer and eventually accept a job, any employment contract is solely between you and that employer – NPLOY.NET is not part of it and has no liability for any disputes that arise (for example, if the job does not meet your expectations or if the employer breaches your agreement). Similarly, if you attend an interview or go to an employer’s worksite, you are responsible for your own safety and conduct. We recommend you research the employer (you can use ratings or reviews, or information in the Platform if available, as well as external sources) before taking significant steps​. Understand that while we connect you to opportunities, the ultimate risk and reward of pursuing a job is yours.

Limitation of Liability:
To the extent permitted by law, NPLOY.NET will not be liable for any indirect damages or lost opportunities arising out of your use of the Platform. Direct liability, if any, will be limited to a small amount (possibly the total value of services we provided to you for free, which is often zero). In plain language, because our service to job-seekers is generally free of charge, and we function as an intermediary, our liability to a user is extremely limited. We do not control employers, and we do not guarantee outcomes; therefore, we cannot be responsible for things that go wrong in the employment process. However, nothing in these Terms is meant to limit rights that by law cannot be limited, such as your rights under consumer protection laws or in cases of our gross negligence or intentional misconduct. If you are in a jurisdiction that disallows certain liability limitations, those limitations in these Terms will apply to the fullest extent allowed.

User Indemnity: You agree to indemnify and hold NPLOY.NET harmless from any claims or liabilities arising out of your breach of these Terms or misuse of the Platform. For example, if you post content that infringes someone’s rights and they sue us, or if you defraud an employer, you would cover us for those issues.

In the event that any of the clauses of these Terms proves to be invalid, this will not invalidate other clauses.

The legislation of the Republic of Bulgaria shall apply to unsettled issues.
